PoolFlo Terms of Service

1. Agreement to Terms

By accessing or using the PoolFlo platform, including booking services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the platform.

2. Marketplace Platform

PoolFlo Inc. operates a technology platform that connects customers with independent service providers (“Contractors”).

  • Contractors are independent businesses

  • Contractors control the manner and means of performing services

  • PoolFlo does not employ Contractors

PoolFlo may establish service standards, guidelines, and quality expectations, but does not control how Contractors perform their work.

3. Services

Contractors may offer:

  • Recurring pool maintenance

  • One-time cleanings

  • Additional services as agreed

The scope of each service is defined by the Contractor and your selected plan.

PoolFlo’s role is limited to facilitating:

  • Booking

  • Payments

  • Communication

  • Platform access

4. User Eligibility

You must be at least 18 years old to use PoolFlo.

4A. Service Standards & Quality Assurance

PoolFlo maintains platform-wide service standards to promote consistency and customer satisfaction.

  • Contractors are provided with recommended service guidelines and task checklists based on the needs of each property

  • Contractors are responsible for determining how to perform services using their own skill, judgment, and methods

To support quality assurance:

  • Contractors may be required to submit photos or documentation of completed work

  • PoolFlo may review submitted materials to evaluate service quality and platform compliance

PoolFlo’s quality assurance processes are intended to verify outcomes, not to direct or control the manner or means by which Contractors perform their work.

5. Booking, Payments, and Billing

  • All payments are processed through Stripe

  • PoolFlo collects payment on behalf of Contractors

  • Funds are held and distributed to Contractors on a scheduled basis

Subscription Terms

  • Services are billed monthly in advance

  • Subscription auto-renews each billing cycle

  • You must cancel at least 2 days before renewal to avoid being charged

Failed Payments

  • If payment fails:

    • Service is paused immediately

    • No Contractor will be dispatched

    • Service resumes only after payment is successfully processed

6. Pricing & Adjustments

Quotes are based on customer-provided information and photos.

PoolFlo reserves the right to:

  • Adjust pricing after initial inspection

  • Require re-quoting if conditions differ materially

  • Cancel service and issue a refund if pricing cannot be agreed upon

7. No Refund Policy

All payments are non-refundable.

  • Customers may cancel future service at any time

  • If canceled mid-cycle:

    • Remaining services may be used

    • Or forfeited at the customer’s discretion

8. Disputes & Service Quality

If a service is disputed:

  • Customer must provide supporting evidence (e.g., photos)

  • PoolFlo will review the claim

If service is determined to be substandard:

  • A follow-up service may be scheduled

  • Contractor compensation may be reduced

PoolFlo does not guarantee outcomes, only facilitation of resolution.

9. Property Access & Customer Responsibilities

You agree to:

  • Provide safe and unobstructed access

  • Secure pets and disclose animal risks

  • Provide accurate gate codes and instructions

Failure to provide access may result in:

  • Missed service

  • Applicable service charges

10. Pool Condition & Service Limitations

PoolFlo services are limited to routine maintenance and cleanliness.

  • Green/swamp pools require separate service and additional fees

  • Customers are responsible for supplying all chemicals

  • PoolFlo may recommend required chemicals

PoolFlo and Contractors are not responsible for:

  • Pre-existing conditions

  • Equipment failure

  • Water chemistry issues beyond routine maintenance

11. Independent Contractor Risks

You acknowledge:

  • Contractors enter your property at your request

  • PoolFlo does not guarantee Contractor conduct

Contractor Liability

  • Contractors are solely responsible for their actions

  • PoolFlo is not liable for:

    • Property damage

    • Theft

    • Personal injury

12. Injuries, Pets, and Property Risk

  • Property owners are responsible for conditions on their property

  • Any injury caused by animals or unsafe conditions is solely between:

    • Customer and Contractor

Contractors assume the risks associated with entering private property.

PoolFlo bears no liability for:

  • Injuries

  • Death

  • Property incidents

13. Background Checks Disclaimer

PoolFlo may use third-party providers such as Checkr to conduct background checks.

However:

  • Background checks are limited in scope and time

  • PoolFlo does not guarantee safety or reliability

  • Customers use the platform at their own risk

14. Contractor Performance & Platform Enforcement

Contractors are subject to platform standards.

Failure to perform services may result in:

  • Suspension

  • Removal from the platform

PoolFlo may reassign services at its discretion.

15. Platform Circumvention

You agree not to:

  • Hire Contractors outside of PoolFlo

  • Circumvent the platform to avoid fees

Any attempt to bypass PoolFlo may result in:

  • Account suspension or termination

Contractors who solicit off-platform work will be permanently removed.

16. Limitation of Liability

To the fullest extent permitted by law:

  • PoolFlo is not liable for:

    • Indirect or consequential damages

    • Lost property

    • Personal injury

    • Contractor misconduct

PoolFlo’s total liability is limited to: The amount paid for the most recent service

17. Indemnification

You agree to indemnify and hold harmless PoolFlo from any claims arising from:

  • Your use of the platform

  • Property conditions

  • Interactions with Contractors

18. Arbitration & Dispute Resolution

All disputes will be resolved through binding arbitration, not in court.

  • No class actions permitted

  • Arbitration will take place in Maricopa County, Arizona

You waive your right to:

  • Jury trial

  • Participation in class actions

19. Contractor Status

Contractors are solely responsible for:

  • Taxes

  • Insurance

  • Licensing

  • Compliance with laws

PoolFlo does not employ Contractors.

20. Service Availability

PoolFlo may:

  • Reassign Contractors

  • Modify availability

  • Cancel services due to operational constraints

21. Intellectual Property

All platform content is owned by PoolFlo and may not be copied or used without permission.

22. Governing Law

These Terms are governed by the laws of the State of Arizona.

23. Changes to Terms

We may update these Terms at any time. Continued use constitutes acceptance.
